These Terms of Service ("Terms") set out the basis on which Acacia Property Care ("we", "us", "our") provides property maintenance, holiday-let care and compliance coordination services to clients ("you", "your").
1. Our services
We provide maintenance, inspection, small works and coordination of specialist services (such as Gas Safe and electrical inspections) for properties in Devon, particularly holiday lets and rental properties. The specific scope of work for each job or ongoing arrangement will be agreed with you in writing (for example by email or in a written quote).
2. Estimates and quotes
Any prices, estimates or quotes we provide are based on the information available at the time. We will always aim to be clear and transparent about expected costs. If, on inspection or during the course of the work, it becomes clear that additional work is required or conditions differ significantly from what was described, we will discuss this with you and, where possible, seek your approval before proceeding with any additional chargeable work.
3. Access and client responsibilities
You are responsible for ensuring that we, and any specialist contractors we coordinate on your behalf, have safe and reasonable access to the property at the agreed times. This includes:
- Providing keys, codes or arrangements with key-safe/agents where applicable.
- Letting us know about any known hazards at the property (for example, structural issues, dangerous electrics, aggressive animals).
- Making sure any guests, tenants or managing agents are aware of our scheduled visits where necessary.
4. Pricing and payment
Our charges may be based on an hourly rate, a fixed price per visit, or a bespoke plan agreed with you. The structure applicable to your property will be set out in writing.
Unless otherwise agreed, invoices are payable within the timeframe stated on the invoice. We reserve the right to charge interest or apply late payment measures in line with applicable UK law where invoices remain unpaid beyond the due date.
5. Cancellations and missed appointments
We understand that plans can change. If you need to cancel or rearrange a visit, please notify us as early as possible. Where visits are cancelled at very short notice or we are unable to gain access to the property at the agreed time (for example because keys are not available), we may charge a reasonable fee to cover time and travel costs.
6. Quality of work and defects
We aim to carry out all work with reasonable care and skill, in line with good practice for the type of work undertaken. If you have concerns about the quality or suitability of work we have carried out, please let us know promptly so we can review the issue and, where appropriate, put things right.
7. Use of specialist contractors
For certain types of work (such as Gas Safe inspections, electrical testing and certification), we may coordinate suitably qualified third-party contractors on your behalf. Those contractors are responsible for the work they carry out and for any certificates they issue. We will take reasonable care in selecting and coordinating such contractors but are not responsible for work performed by independent third parties beyond our direct control.
8. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other matter where liability cannot be limited or excluded under UK law.
Subject to the above, we will not be liable for:
- Indirect or consequential loss, such as loss of profit, loss of bookings or loss of business reputation.
- Issues arising from underlying defects, wear and tear, or conditions at the property that were not reasonably apparent or that we were not made aware of.

10. Intellectual property

12. Governing law
These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
